LX Hospitality LLC, doing business as TEN32 Midtown ("TEN32," "we," "us," or "our"), explains in this Privacy Policy how we collect, use, disclose, and protect personal information in connection with our website, inquiries, bookings, communications, and venue operations.

This policy applies to information we handle about website visitors, prospective renters, customers, event contacts, vendors, and venue visitors. It does not replace our Terms of Use or rental agreements. Independent booking platforms, payment providers, event organizers, and other third parties may also process information under their own privacy notices.

Information we collect

Contact information. Your name, email address, telephone number, mailing or billing address, company or organization, and information you include in emails, forms, messages, and other communications.

Inquiry and booking information. Requested dates and times, rental type and duration, attendance, budget, food and beverage plans, vendor details, special requests, how you found us, and records of quotes, reservations, changes, and rental history.

Verification and rental documents. Rental agreements, signatures, insurance certificates, authorizations, and identification requested to verify the renter or administer a reservation. An identification document may contain a photograph, address, date of birth, or identification number. Provide only the information requested through the designated submission method.

Payment information. Invoices, amounts paid or due, transaction references, payment status, and relevant billing or dispute records. Payment providers process the payment credentials submitted through their systems. Our access depends on the payment method and provider. Do not send full card details or security codes through an ordinary inquiry form or email.

Website information. IP address, browser and device information, approximate location inferred from network information, pages visited, referral source, timestamps, interactions, cookie identifiers, and advertising identifiers when the relevant tools are active.

Content and operational records. Reviews, photographs, or other content you provide, and records of complaints, property damage, access issues, or other incidents. Security footage is addressed separately below.

Please avoid sending Social Security numbers, medical records, or unrelated sensitive information. If an accessibility request involves sensitive details, contact us so we can identify what information is necessary.

Where information comes from

We receive information directly from you, automatically through your use of our website, and from people arranging an event or reservation on your behalf. We may also receive information from booking and payment services, referral platforms, vendors, insurers, and building management when relevant to your inquiry, reservation, or an incident.

If you provide another person's information, provide only what is necessary and ensure that you have an appropriate basis to share it. Event organizers are responsible for their own guest registration and privacy notices.

 

How we use information

We use information to answer inquiries; recommend suitable rental options; prepare quotes and agreements; verify reservations; administer bookings and payments; coordinate access, staffing, vendors, insurance, and event requirements; and provide customer support.

We also use relevant information to maintain accounting and business records, investigate incidents and payment disputes, enforce agreements, prevent fraud, protect people and property, comply with legal obligations, and establish or defend legal claims.

Website and advertising information helps us understand visitor activity, improve the website and booking experience, and measure advertising results. Where permitted, we use contact details to share venue news and offers, subject to your choices and any consent required by law.

 

Cookies, analytics, and advertising

Cookies and similar technologies can support website operation, security, preferences, analytics, and advertising measurement. Some are necessary to provide a requested service. Others require a choice or consent depending on the technology and applicable law.

We use Google Analytics to understand how people find and use our website. When Google tags are active, information such as page addresses, online identifiers, device information, and interactions may be sent to Google. Google Ads measurement, where enabled, helps us understand whether an advertisement leads to an inquiry or booking. The data processed depends on the features and settings in use.

Where a cookie preference tool is available on our website, use it to review or change optional cookie choices. You can also control cookies in your browser. Blocking cookies may affect certain features. Choices may need to be repeated on different devices or browsers, or after cookies are cleared. Opting out of personalized advertising does not remove all advertisements or all permitted measurement.

Where required by applicable law, we obtain consent before activating relevant optional technologies. This Privacy Policy does not itself constitute consent to optional tracking.

 

How we disclose information

Service providers. We disclose information needed by providers supporting our website, forms, scheduling, payments, business email, record storage, communications, analytics, and advertising. Providers used for our current services include Wix, Acuity Scheduling, Stripe, and Google. Their roles and the information they receive depend on the service you use and the tools enabled.

Operations and requested services. Authorized staff and contractors may access information needed for their duties. We may share relevant reservation and access details with building management, security, event contacts, or vendors to arrange the services requested. A vendor referral does not authorize unrestricted sharing of your records.

Legal and protective purposes. We may disclose relevant information to legal and accounting advisers, insurers, payment providers, authorities, or other parties when reasonably necessary to comply with legal requirements, investigate an incident or suspected fraud, resolve disputes, or protect lawful rights and safety.

Other permitted disclosures. Information may be disclosed during a proposed or completed merger, sale, reorganization, or similar business transaction, subject to applicable law and appropriate protections. We may also disclose information at your direction or with your consent.

Certain advertising disclosures can be classified as a sale, sharing, or targeted advertising under privacy laws even when no money is exchanged. Any such classification and related rights depend on our actual advertising setup and whether the relevant law applies. See the choices and rights sections of this policy.

 

Booking and payment services

When you book through Acuity Scheduling or pay through a payment provider such as Stripe, information is handled by that provider as well as by TEN32 to administer your reservation. Providers may also process information for their own security, legal, and other disclosed purposes. A separate booking marketplace or vendor is responsible for its own information practices.

Communications and marketing choices

We may contact you about an inquiry, quote, reservation, payment, venue access, required documents, or a service issue using the contact details you provide. These operational communications are separate from promotional messages.

You may opt out of promotional emails using the unsubscribe instructions in the message or by emailing info@ten32midtown.com. We will process requests within the period required by applicable law. We may retain a limited suppression record to help ensure that your preference is respected. Opting out of marketing does not prevent necessary communications about an existing reservation or transaction.

Providing a telephone number for an inquiry or booking does not, by itself, authorize every form of automated marketing call or text. Any marketing program requiring additional consent must obtain that consent separately.

 

Venue security and incident records

Where security cameras are in operation, footage may capture people entering or using monitored areas. We use relevant security and incident records to support safety, protect property, investigate incidents, and resolve disputes. Footage may be shared with authorized personnel, building management, insurers, advisers, or authorities when appropriate for those purposes.

A building operator may operate its own cameras independently. Contact us if you need information about recording practices before attending.

 

Event photographs and testimonials

We may receive photographs, videos, reviews, and testimonials from renters, photographers, or other contributors. Before using identifiable people's images or private event material in our marketing, we obtain any permission required by law and applicable agreements. Additional permission may be needed for images of children or material created by another person.

This Privacy Policy does not grant us a blanket release to use your name, likeness, or event content. Event organizers and photographers may have separate arrangements. Contact us about privacy concerns involving material displayed on our channels.

 

Retention

We retain information for the period reasonably necessary for the purposes described in this policy, unless a longer period is required or permitted by law. Relevant factors include whether an inquiry remains active, the duration of our customer relationship, accounting and tax requirements, insurance obligations, fraud prevention, and the time needed to resolve disputes or legal claims.

Identification documents, security footage, marketing records, and website data can require different retention periods from rental agreements and transaction records. We assess those categories separately. Information relevant to an incident or legal hold may need to be preserved beyond the usual period. When it is no longer needed, we take steps to delete, anonymize, or securely dispose of it, subject to applicable backup and legal requirements.

 

Security and international access

We use administrative, technical, and organizational safeguards designed to protect personal information and limit access to people who need it for authorized purposes. No website, transmission method, or storage system can be guaranteed completely secure. If you believe information you provided to us has been compromised, contact us promptly.

TEN32 operates in the United States. Information may be stored or accessed in other countries by our providers or authorized support personnel, including administrative support in India where used. Those countries may have different privacy laws. Where applicable law requires protections for international transfers, we use the required lawful transfer arrangements. Visiting our website is not treated as blanket consent to a transfer that requires a separate legal basis.

 

Privacy requests and rights

Depending on where you live and whether the relevant law applies to TEN32, you may have rights to request access to or a copy of information, correction, deletion, portability, restriction of certain processing, or an explanation of relevant disclosures. You may also have rights to object to processing, withdraw consent, or opt out of a qualifying sale, sharing, or targeted advertising.

We may take reasonable steps to verify your identity or an authorized representative's authority. Please do not send identification documents unless we request them through an appropriate method.

We respond within the time required by applicable law. Rights may be subject to exceptions, including obligations to retain transaction records, protect others' information, or address legal claims. Where the law provides an appeal, you may email us with the subject "Privacy Appeal." You may also have a right to complain to the relevant regulator. We will not unlawfully discriminate against you for exercising applicable rights.

 

Additional information where European or UK law applies

If European Economic Area or United Kingdom data protection law applies to our processing, LX Hospitality LLC is the controller for information whose purposes and use it determines. Depending on the activity, the legal basis may be steps requested before entering a contract, performance of a contract, a legal obligation, legitimate interests in operating and protecting our business that are not overridden by your rights, or consent where required.

Where we rely on consent, you may withdraw it without affecting processing that was lawful before withdrawal. You may object to processing based on legitimate interests and to direct marketing as provided by applicable law. Children, external content, and links

Our website and booking services are intended for people arranging venue rentals and are not directed to children under 13. If you believe a child has submitted personal information to us online without appropriate authorization, contact us so we can investigate and take appropriate action. Children attending a private event does not make them independent booking customers; their information should be provided only when necessary and by an appropriate adult.

External links and embedded services may take you to, or load content from, another provider. That provider may receive information when its content loads or when you interact with it. Review the relevant privacy notice. This policy describes TEN32's practices and does not replace another organization's notice.

 

Changes to this policy

We may update this policy to reflect changes to our services, information practices, or legal requirements. The revised policy will show an updated effective date. Where required, we will provide additional notice or obtain consent before applying a material change. An update does not retroactively authorize uses that require separate permission.
